Public comment letters on Chavallo retaining wall encroachment NEW
- Mr. Chavallo has requested approval of an encroachment permit to allow for construction of a retaining wall in the KID’s Main Canal right of way as part of his Citadel Estates project located west of Panoramic Heights. The Chavallo retaining wall encroachment permit is not on the KID Board’s Dec. 1st agenda.
- KID’s engineering department has been processing Chavallo’s permit for several months through the District’s Operations and Engineering committee. We will also post the staff report when it has been finalized.
- The decision on the proposed retaining wall encroachment proposal will be made by the US Bureau of Reclamation. KID will be making a recommendation to the Bureau of Reclamation. The encroachment permitting process does not include a public hearing, although you can send a letter to District Manager Charles Freeman articulating the reasons that you believe that the permit should be approved or denied. - The District's right-of-way maps for this section of the Main Canal show that the abutting property owners own the land under the canal. KID operates and maintains the right-of-way on behalf of the USBR. In some other areas KID owns the land under the canal.
- If Mr. Chavallo proposes to pipe the storm water from his project under the KID’s Main Canal he will need to obtain a permit from KID. The District has a master crossing agreement with the US Bureau of Reclamation, which authorizes the District to act on certain routine kinds of aerial and underground canal crossings e.g. phone lines, water pipes, gas lines, phone/cable TV lines, etc. when designed and installed in accordance with the applicable technical specifications. There are over a hundred of these kinds of crossings throughout the District’s 88 miles long canal system. Retaining walls do not fall under the master crossing agreement. One example of a crossing is the high pressure Williams gas pipeline that crosses under the Main Canal near Panoramic Heights.
